Introduction

This Privacy Policy describes Our policies and procedures on the collection, use, and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You.

We use Your Personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Artificial Intelligence (AI) Features: Refers to functionalities within the Service that utilize artificial intelligence to generate text, images, or ideas for social media posts based on Your inputs.
Company (referred to as either "the Company", "We", "Us", or "Our" in this Agreement): Refers to SocialMe Ai.
Cookies: Small files placed on Your computer, mobile device, or any other device by a website, containing the details of Your browsing history on that website among its many uses.
Country: Refers to Telangana, India.
Device: Any device that can access the Service such as a computer, a cellphone, or a digital tablet.
Personal Data: Any information that relates to an identified or identifiable individual.
Service: Refers to the Website and the Application, including all its features such as AI content generation, post idea generation, and post scheduling for social media platforms.
Service Provider: Any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service (including but not limited to AI model providers, hosting services), or to assist the Company in analyzing how the Service is used.
Social Media Platforms: Refers to third-party social media services that You may choose to connect Your Account to, such as Instagram, Facebook, LinkedIn, and X (formerly Twitter).
Third-party Social Media Service: Refers to any website or any social network website through which a User can log in or create an account to use the Service, or connect their existing social media accounts.
Usage Data: Data collected automatically, generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
User-Generated Content: Refers to any text, images, or other materials that You create, generate (including through AI Features), upload, or schedule for posting through the Service.
Website: Refers to SocialMe Ai, accessible from https://socialmeai.com.
You: The individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collecting and Using Your Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

Email address
First name and last name (optional, for account personalization)
Payment Information (if applicable for premium features, processed by a third-party payment processor)
Usage Data

Information from Third-Party Social Media Services / Social Media Platform Data

The Company allows You to connect Your accounts on Third-Party Social Media Services (such as Instagram, Facebook, LinkedIn, X) to Our Service. If You choose to connect Your Social Media Platform accounts, We may collect Personal Data that is already associated with Your Third-Party Social Media Service's account, such as Your name, Your profile information, and access tokens necessary to provide the Service. We will only access and use this information with Your explicit authorization, typically through an OAuth flow provided by the Social Media Platform.

Specifically for Instagram:

When You connect Your Instagram account, We may request permissions to access information and perform actions on Your behalf as permitted by the Instagram API and Your authorization. This may include:
- Accessing Your Instagram profile information (username, profile picture).
- Permission to publish posts (images, videos, captions) to Your Instagram account as You direct through the Service.
- Accessing basic data about Your media and posts made through our Service.
We do not collect or store Your Instagram password. Authentication is handled through Instagram's secure OAuth mechanism.
Our use of data obtained from the Instagram API will comply with Instagram's Platform Terms and Developer Policies.

The information We collect from Social Media Platforms is used solely to provide and improve the features of Our Service, such as scheduling posts, generating content ideas relevant to Your audience, and allowing You to manage Your social media presence through Our platform. You can disconnect Your Social Media Platform accounts from Our Service at any time through Your Account settings or by revoking access through the respective Social Media Platform.

User Inputs for AI Features and AI-Generated Content

When You use Our AI Features, We collect the prompts, text, topics, or any other input You provide ("AI Inputs"). We also process the content generated by the AI Features based on Your inputs ("AI-Generated Content"). This AI-Generated Content is then part of Your User-Generated Content.

AI Inputs are processed by Our AI Service Providers to generate the AI-Generated Content.
We may store AI Inputs and AI-Generated Content in association with Your Account to allow You to access, edit, and use them within the Service.
We do not use Your specific AI Inputs or AI-Generated Content to train our general AI models offered to other users unless we explicitly state so and provide you with an option to opt-out, or if the data is aggregated and anonymized.

Usage Data

Usage Data is collected automatically when using the Service. Usage Data may include information such as Your Device's Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers, and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Newsletter and Marketing Emails

The blog newsletter, and what subscribing stores

If You subscribe through the form on Our blog, We store the following, and nothing else:

Your email address, lowercased and trimmed.
A name, only if You have given Us one — the subscribe form on the blog does not ask for a name, and the field stays empty unless it is filled from somewhere You already told Us.
Which page You subscribed from — the blog index, or a particular post.
The IP address and browser user agent the subscription was submitted from, and the time it happened. This is the record of Your consent: it is what allows Us to show that a subscription was asked for rather than added by Us. It is taken from the request itself, never from anything the form submits.
Timestamps for when the confirmation email was sent, when You confirmed, and when You unsubscribed, as each of those happens.
Two random tokens: one that confirms the subscription, which is single-use and stops working after 7 days, and one that unsubscribes You, which is deliberately long-lived so that an unsubscribe link in an old message still works.

Nothing is sent to You until You click the link in the confirmation email. If You never click it, the address stays unconfirmed and receives no newsletter.

Emails to people with an account

If You have an account with Us, You may receive occasional emails about Our product. We do not copy Your address into a separate mailing list for this: the recipients are resolved from Your account record at the moment a message is sent, so an account that has been deleted or closed is never mailed. Every such message carries a one-click unsubscribe, and using it stops that mail without affecting Your account or any other list.

Opens and clicks in marketing emails

Marketing emails — a campaign sent to a list, not a confirmation or a message about Your account — carry two pieces of measurement. We disclose both because neither is visible to You while it happens:

A single transparent image. If Your mail client loads images, fetching it tells Us the message was opened. We record which campaign it was, which sent message it was, the address it was sent to, and the time.
Links that pass through Our own site. A link in a marketing email points at Our domain and forwards You to the real destination. We record the same four things, plus the address of the link You followed, and then the redirect happens.

The identifier in those addresses is a random id for one sent message. It is not Your email address: the address is looked up on Our side, so it does not travel in a URL that sits in Your mailbox, in a forwarded copy, or in the access logs of anything the message passes through. We do not record Your IP address or Your browser for either of these, and We do not use them to build a profile, target advertising, or share anything with a third party for their own purposes.

Every open and every click is recorded separately rather than collapsed, so a message opened twice is two entries. These entries are kept with the campaign record for as long as We keep the campaign, and they are deleted along with Your contact record if You ask Us to delete it.

Two honest limits. Open measurement is unreliable in Our favour and We do not treat it as fact: several mail providers, Apple Mail among them, fetch images automatically before You see a message, which registers as an open that never happened. And You can prevent open measurement entirely by leaving remote images switched off in Your mail client — the message still reads correctly. To avoid the link measurement, use the unsubscribe link; there is no way to open a tracked link without passing through the redirect.

Lawful basis

For the blog newsletter, Our lawful basis is Your consent, given by submitting the form and confirming by email. You may withdraw it at any time using the unsubscribe link in any message, or by contacting Us. The consent evidence described above — IP address, browser, timestamp — is retained so that We can demonstrate the consent was given, which is itself a requirement of the relevant data protection law.

For product emails to existing account holders, Our lawful basis is Our legitimate interest in telling Our own customers about the Service they use, together with the existing-customer relationship. You have the right to object, and the one-click unsubscribe in every message is how to exercise it.

For the open and click measurement described above, Our lawful basis is Our legitimate interest in knowing whether the email We send is worth sending — how many people We reach and which subjects are read. It is limited to that: the entries are counted per campaign and not used to build a profile of You, and disabling remote images or unsubscribing ends it. You have the right to object to it, on its own, by contacting Us.

Bounces and spam reports

Our email provider tells Us when a message is permanently rejected by a receiving mail server, or when a recipient marks it as spam. In either case We record the address, the reason, and the time, and We stop sending marketing email to that address on every list. That record is kept for as long as We send email at all, on purpose: deleting it would mean We could mail the address again, which is the outcome it exists to prevent. It does not block service email about an account You hold, such as a password reset.

Retention

A subscription record is kept until You ask Us to delete it. Unsubscribing does not delete it: the row is marked unsubscribed and the time is recorded, because that record is the evidence that You asked Us to stop and the reason We will not mail You again. There is no automatic expiry — an unconfirmed subscription is simply never mailed, and a confirmed one lasts until You end it or ask Us to remove it.

How to be deleted

Email [email protected] from the address concerned, or tell Us which address it is, and ask Us to delete it. We will remove the contact record, its subscription to every list, and the consent evidence attached to it.

Two things are worth stating plainly before You ask. If Your address is on the bounce or spam-report record described above, We keep that entry unless You specifically ask Us to remove it as well — and if We do remove it, nothing prevents the address from being mailed again should it re-enter a list. And deleting a newsletter subscription does not delete Your account: if You hold one, see Your Data Protection Rights below.

Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on Our Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Service. The technologies We use may include:

Cookies or Browser Cookies. A cookie is a small file placed on Your Device. You can instruct Your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if You do not accept Cookies, You may not be able to use some parts of our Service. Unless you have adjusted Your browser setting so that it will refuse Cookies, our Service may use Cookies.

Certain sections of our Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity).

Cookies can be "Persistent" or "Session" Cookies. Persistent Cookies remain on Your personal computer or mobile device when You go offline, while Session Cookies are deleted as soon as You close Your web browser.

To enable AI Features: To process Your AI Inputs and provide You with AI-Generated Content.
For the performance of a contract: the development, compliance, and undertaking of the purchase contract for the products, items, or services You have purchased or of any other contract with Us through the Service.
To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products, or contracted services, including the security updates, when necessary or reasonable for their implementation.
To provide You with news, special offers, and general information about other goods, services, and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
To manage Your requests: To attend and manage Your requests to Us.

For instance, User-Generated Content and AI Inputs/Outputs linked to Your Account will be retained as long as Your Account is active, or until You choose to delete them, subject to any overriding legal or operational retention needs.

Usage Data will generally be retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those from Your jurisdiction.

Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security. Our Service does not address anyone under the age of 13 (or a higher age threshold depending on the jurisdiction, e.g., 16 in some parts of Europe).
